I. Definitions.

The terms used in the Terms and Conditions and the Privacy Policy shall have the following meanings, respectively:

  1. Cookies – means IT data, in particular small text files, which are saved and stored on devices enabling the User to use the Website.
  2. Personal data – means information relating to an identified or identifiable natural person (“data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.
  3. Processing – means an operation or a set of operations performed on personal data or their sets, whether by automated or non-automated means, such as: collection, recording, organization, structuring, storage, adaptation or modification, retrieval, consultation, use, disclosure by transmission, dissemination or other forms of making available, alignment or combination, restriction, erasure or destruction.
  4. Terms and Conditions – these terms and conditions for the provision of services available on the musclecraft.pro website.
  5. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)
  6. Website www.musclecraft.pro – means the website available at www.musclecraft.pro together with all its subpages, through which the Seller provides services to the Users.
  7. External website – means websites belonging to partners, service providers or service recipients cooperating with the Administrator.
  8. Seller – means a musclecraft.pro who is an entity responsible for the provision of services available on the Website.
  9. Device – means an electronic device that allows the User to access the Website.

User – means a person or entity that uses the content and functionalities available on the Administrator’s Website or to whom, in accordance with the Terms and Conditions and the law, services may be provided electronically or with whom a Contract for the provision of services by electronic means may be concluded.

II. General provisions.

  1. The Terms and Conditions define the terms and conditions of using the services provided through the website www.musclecraft.pro to the Users.
  2.  The owner and administrator of the www.musclecraft.pro Website is MG.
  3.  The Terms and Conditions constitute an integral part of the Agreement for the provision of services by electronic means, which is concluded at the moment of commencement of use by the User of the services offered on the www.musclecraft.pro website.
  4.  The materials made available to Users on the www.musclecraft.pro website, including its content and layout, are the property of MG (or another entity) and are protected by the provisions of the Act of 4 February 1994 on copyright and related rights (i.e. Journal of Laws of 2023, item 283, as amended). The use of the website does not entitle the User to a claim for the transfer of copyrights, either in part or in whole.
  5.  Musclecraft.pro informs Users that due to the public nature of the Internet, the use of the services of the www.musclecraft.pro website may involve the risk of unauthorized interference of third parties in the transmission of data between the website and the User.
  6. Musclecraft.pro reserves that during the maintenance of ICT systems, access to the services provided through the www.musclecraft.pro website may be temporarily limited or impossible. Musclecraft.pro is not responsible for such interruptions, but undertakes to make every effort to ensure that such interruptions occur as rarely as possible and last as short as possible.

III. Terms of Service www.musclecraft.pro.

1. Technical conditions for using the website:

  • An active email account.
  • A properly configured web browser that accepts cookies and supports JavaScript.
  • Access to a device with an active Internet connection to browse the web.
  • Installed software that handles PDF files (e.g. Adobe Reader).

2. Material Supply:

The materials provided by musclecraft.pro to the User are sent in PDF format to the e-mail address provided by the User.

3. Formal conditions for using the website:

  • Only a natural person who: a) is at least 18 years of age, is not incapacitated and has accepted the Terms and Conditions may be a User.
  • Some of the services available on the www.musclecraft.pro website are made available only to Users who: a) have paid for access to selected services in accordance with the terms and conditions set out on the Website.
  • The User is obliged to use the services of the website in accordance with the provisions of the Terms and Conditions, applicable law and good practices adopted on the Internet.
  • In the course of using the www.musclecraft.pro services, the User must not: a) publish content that is illegal, vulgar, offensive or infringing the rights of third parties; b) publish personal data or images of third parties without their consent; c) make the content of private correspondence available without the consent of the sender; d) publish material that infringes copyright, including tips and instructions on how to violate it.

4. Rights and liability of the website:

  • Musclecraft.pro reserves the right to:a) temporarily or permanently change the parameters of the services available free of charge, including their suspension or discontinuation, without the need to give a reason, provided that the Users are informed in advance; b) block or remove materials that violate the provisions of the Terms and Conditions.
  • The costs of connecting to the Internet and using the devices belonging to the User are not covered by Musclecraft.pro.

IV. Paid services on the musclecraft.pro website.

Musclecraft.pro provides paid services to the Users, which include, among others:a) sale of training plans,b) training and video-training,c) ebooks,d) courses and graphics.

The user using paid services also has access to all services provided free of charge. Musclecraft.pro also offers free services available to all Users on the Website.

V. Terms of use of paid services musclecraft.pro.

The use of paid services requires prior payment for the selected product or service. Payment details (including accepted payment methods and procedure) are available on the www.musclecraft.pro website.

VI. Rules for the provision of paid services www.musclecraft.pro.

  • The provision of paid services begins after the payment is credited and the User fills in the required contact details, including a valid e-mail address.
  • The standard time of providing services, understood as the commencement of the provision or making available of the ordered materials, is from 1 to 6 working days from the date of confirmation of the payment being credited. In the event of delays, the User will be informed immediately by email.
  • Musclecraft.pro grants the User a non-exclusive, non-transferable license to use the materials made available as part of the paid services, solely for their own use, without the right to further distribute, copy, modify or make them available to third parties. The license is valid for the duration of the paid musclecraft.pro services.

VII. Fees.

  1. The condition for using paid musclecraft.pro services is to pay a fee for the selected service.
  2. Payment for musclecraft.pro services is made through the available payment methods specified by the payment operator.
  3. The User is obliged to indicate the selected paid service and pay a fee in accordance with the current price list.

VIII. Order processing.

  1. After the payment is credited, a link to the page where you can download the ordered products is sent to the e-mail address provided when placing the order.
  2. After clicking on the link, the files with the products are automatically saved on the User’s device.
  3. An order is considered completed after downloading the files with the ordered products. The basis for determining the correct download is a record in the musclecraft.pro IT system, confirming the successful transmission of files, regardless of who made the actual download.
  4. The user is not allowed to share the download link for the products with third parties. Violation of this obligation constitutes a breach of the terms of the license and results in the obligation to pay a contractual penalty in the amount of three times the value of the purchased product.

IX. Complaints and returns.

  1. The User has the right to file a complaint regarding paid services provided by musclecraft.pl within 14 days from the date of their implementation or the occurrence of a problem related to the use of these services, subject to point 5 below.
  2. Complaints should be submitted electronically by sending a notification to the following e-mail address: contact@musclecraft.pro. The complaint should include:a. the User’s name and surname, b. the e-mail address used during the purchase, c. the order number (if applicable), d. a description of the problem giving rise to the complaint.
  3. musclecraft.pro will consider the complaint within 14 working days from the date of its receipt. The User will be informed about the result of the complaint by e-mail.
  4. The User has the right to withdraw from the contract within 14 days of its conclusion, unless the service has been fully performed before the expiry of this period, which the User accepts when starting to use the service.
  5. Complaints regarding ordered digital products (e.g. e-books, training plans, graphics, video-training) are not taken into account after they are downloaded by the User, which is tantamount to the full performance of the service.
  6. In the event of a refund of the fee for the service not performed, the funds will be returned to the User’s bank account or in another way agreed by the parties, within 14 days from the date of positive consideration of the complaint.
  7. A refund of payment or a positive consideration of the complaint does not release the User from the obligation to comply with the terms of the license granted for the materials made available as part of the musclecraft.pro services.

X. Privacy Policy.

  1. musclecraft.pro reserves the right to anonymously publish questions and answers to musclecraft.pro in connection with the www.musclecraft.pro services, to which the User agrees.
  2. By using the www.musclecraft.pro services, in particular by providing the data necessary to create an account on the Website, the User agrees to the processing of their personal data both at a given time and in the future.
  3. musclecraft.pro declares that:a. attaches particular importance to the protection of the Users’ privacy, using appropriate organizational and technical measures,b. processes the User’s personal data on the basis of their consent and – in certain cases – on the basis of the provisions of law.

XI. Final provisions.

  1. musclecraft.pro reserves the right to make changes to the Terms and Conditions for important reasons, in particular related to:a. change of the terms and conditions of provision of www.musclecraft.pro services,b. change of the terms of use of www.musclecraft.pro services,c. modification of the functionality of the www.musclecraft.pro Website,d. change of applicable law.
  2. Changes to the Terms and Conditions are effective from the moment of their publication on the www.musclecraft.pro Website.
  3. In matters not covered by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code in the scope of contracts for specific work.
  4. Any disputes arising in connection with the User’s use of the www.musclecraft.pro services shall be resolved by the competent Polish common courts, in accordance with the provisions of Polish law and in the Polish language.
  5. If any provision of the Terms and Conditions is found to be invalid by a final court decision, the remaining provisions remain in full force and effect.

The current version of the Terms and Conditions with appendices is always available on the www.musclecraft.pro Website and at the Administrator’s headquarters.
